Terms of Use and Acceptable Use Policy

Welcome to Miaplaza. We're glad you're here. These Terms of Use explain how our websites, applications, virtual K–12 public and private school programs, and homeschool programs work. We've written this document in a parent-friendly tone while still covering the important rules that help keep our learning community safe, respectful, and legally protected.

By using any Miaplaza website, app, or educational program, you agree to these Terms of Use.

1. Definitions

To keep things clear, here are a few terms we use throughout this document:

  • "Miaplaza," "we," "our," or "us" – Miaplaza, the education management company that operates virtual K–12 public and private schools, homeschool programs, and related services.
  • "Services" – All Miaplaza websites, mobile apps, online platforms (including Technology Platform), virtual school programs, homeschool programs, customer support and learning tools, including courses, lessons, evaluations, communication tools, tracking tools, directories, creative tools, and event offerings. We may change, add, or delete features of the services from time to time.
  • "Technology Platform" or "Platform" – The systems we use to deliver our Services, including proprietary software developed by Miaplaza and third-party software used for our education management system (EMS) and learning management system (LMS).
  • "User," "you," or "your" – Students, parents/guardians, educators, and any other individuals who access or use our Services.
  • "Content" – Lessons, videos, assignments, assessments, communications, and any other materials available through our Services.
  • "FERPA" – Family Educational Rights and Privacy Act of 1974 (20 U.S.C. §1232g; 34 CFR Part 99) and similar laws that control the disclosure of student information.
  • "COPPA" – Children's Online Privacy Protection Act (15 U.S.C. § 6501-6505; 16 CFR Part 312)

2. Acceptance of These Terms

By accessing or using our Services, you confirm that:

  • You are at least 18 years old or a parent/guardian providing consent for a minor.
  • You agree to follow these Terms of Use and any additional guidelines we provide.
  • If you are enrolling students in a Miaplaza program, you have the legal authority to do so; you accept these Terms of Use on their behalf; and you assume full responsibility for their compliance.

If you do not agree with these Terms, INCLUDING THE LEGAL PROVISIONS IN SECTIONS 12, 13 AND 14, please do not use our Services.

3. Eligibility and Account Responsibilities

3.1 Account Creation

Some parts of our Services require an account. Parents/guardians must create and manage accounts for students under 18.

3.2 Accuracy of Information

You agree to provide accurate and up-to-date information during enrollment and account setup.

3.3 Account Security

You are responsible for keeping login information private and up to date. Please notify us immediately if you suspect unauthorized access or experiencing access challenges. We are not responsible for recovering accounts linked to inaccessible or outdated email addresses.

3.4 Account Access

a. Accounts that are created, provided or managed by a private or public school (including a school district) (collectively "School") operated or managed by us, or a homeschool program operated by us, then School or homeschool program staff may also have access to manage the account consistent with applicable law, school or homeschool program policy. Account management may include the ability to disable or restrict Service features.

b. Access to Account social features is restricted to minors. Parents/guardians may also request access to social features with community functionality disabled. We may disable any account believed to be in violation of these restrictions.

c. We may disable your Account access at any time, with or without notice, for violations of these Terms of Use. In addition, we may disable your account access in response to a court order, suspected fraud, security concerns, operational or technical concerns, prolonged inactivity and/or nonpayment. In addition, we will terminate an account upon receiving a written request from you, the account holder. While we are committed to adopting processes for disabling an account that will conform with applicable legal requirements, we retain discretion within that framework to determine the appropriate actions to take under the particular circumstances at play. We are not responsible for the loss of any data or record that is lost as a result of an account being disabled. We reserve the right to retain data and records important to our legitimate business purposes or otherwise required by law.

4. Use of Our Technology Platform

4.1 Proprietary and Third-Party Software

Our Services run on a combination of Miaplaza-developed tools and trusted third-party software, including Artificial Intelligence ("AI") software. By using our Services, you agree to follow all rules and licenses associated with this technology. Please refer to our AI policy to learn how we use AI in the delivery of your student's education program.

4.2 Updates and Changes

We may update or modify our software at any time to improve performance, security, or user experience.

4.3 Digital Millennium Copyright Act (DMCA) Policy

We respect the intellectual property rights of others and we expect our users to do the same. We will respond expeditiously to claims of copyright infringement involving our Platform or Services, including removing the offending content in a manner consistent with applicable legal requirements.

Your notice must include a description of the work you believe is infringing your copyright and sufficient information reasonably sufficient to permit us to locate the alleged infringing work; your contact information, including name, address, telephone number and email address; any other information you believe would be helpful in investigating your claim. Depending on our engagement with you, we may ask you to submit a more formal notice that meets certain legal requirements.

4.4 Platform and Services Security

Users are strictly prohibited from engaging in any activity that undermines or threatens the security of the Platform or the Services. Evidence that shows a violation of this section constitutes grounds for immediate suspension of the users' access believed to be involved in the activity(ies) pending the completion of a full investigation and may lead to permanent termination. Other possible actions include blocking IP addresses, rate-limiting access, and/or reporting the prohibited behavior to law enforcement and/or other regulatory body. Activities violating this section include but are not limited to:

  • Crawling, scraping, or spidering the Service
  • Framing, reducing, or mirroring any portion of the Service
  • Attempting or supporting the unauthorized access of the Platform or any restricted part of the Service
  • Probing or testing system vulnerabilities
  • Any interference or attempted interference with the Service or Platform functionality
  • Any introduction or attempted introduction of harmful code, viruses or malware

4.5 Restrictions

Users may not:

  • Attempt to access or modify the underlying software
  • Copy, distribute, or reverse-engineer any part of the platform
  • Use the platform in ways that disrupt learning or violate laws
  • Engage in any efforts that constitute an attempt at data scraping, extraction or indexing
  • Use the platform to upload, post or otherwise share prohibited "Content". Prohibited Content includes:
    • Personal contact information about yourself, your child or others
    • Posts that we consider to be abusive, harassing, hateful, threatening, or discriminatory
    • Posts that violate your particular School's handbook or other published policy or any applicable state or federal law, including applicable adopted policy by a political subdivision with regulatory authority over the School
    • Posts that request any users passwords, location data, or sensitive identifying information
    • Posts that we find espouses any extremist or violent ideology
    • Posts that promote illegal activity or activities that we consider to cause self-harm or harm to others, including instructions as to how to carry out that activity or where one could find that information
    • Posts that we deem are defamatory, obscene, sexually explicit, or otherwise are inappropriate for, exploits, or endangers minors
    • Any interaction with the platform that introduces or causes an introduction of malware, harmful code, or hidden pages
    • Distributions of any user's personal information outside the platform
    • Any interaction with the platform that constitutes an infringement of any intellectual property rights or that constitutes commercial activity

5. Appropriate Use of Services

To maintain a safe and respectful learning environment, you agree to:

  • Use the Services only for lawful educational purposes
  • Communicate respectfully with teachers, staff, and other students
  • Avoid sharing harmful, inappropriate, or copyrighted materials
  • Follow all school policies if enrolled in a Miaplaza program

We may suspend or remove access if these expectations are not met.

6. Program Participation (Virtual Public, Private, and Homeschool Programs)

6.1 Enrollment Requirements

Each program may have specific enrollment rules, state requirements, or documentation needs. Parents/guardians are responsible for completing all required steps.

6.2 Attendance and Engagement

Students are expected to participate regularly, complete assignments, and follow teacher instructions.

6.3 Parent/Guardian Role

For younger students and homeschool programs, parents/guardians may need to support daily learning activities.

6.4 Teacher and Staff Communication

We encourage open communication. However, abusive or inappropriate behavior toward staff will not be tolerated.

6.5 Federal and State Law

You acknowledge that the particular requirements governing the School or homeschool program in which you or your minor child is enrolled, including how the records and data of you or your minor child are managed and protected, is regulated by specific federal and/or state laws; accreditation and/or contract obligations; and/or, by the respective School's or homeschool programs adopted policies.

6.6 Personal Responsibility

Our Schools and homeschool programs are available to families residing in various jurisdictions. We do not warrant to families that the School or homeschool program in which you enroll your child will meet your particular needs or be fit your particular purpose. We do not guarantee that credits earned, transcripts generated or diplomas issued through the respective School or homeschool program will be accepted by other educational institutions, local school districts or state departments of education. It is the parent/guardian's sole responsibility to ensure the child's academic program meets the child's/family's particular needs and that it is fit that purpose.

7. Content Ownership and Intellectual Property

7.1 Miaplaza Content

All lessons, videos, curriculum materials, and platform features are owned by Miaplaza or our content partners. You may use them only within our Services as permitted by us.

7.2 User-Generated Content

If you or your student submit assignments, messages, or other content, you grant Miaplaza permission to use that content for educational and operational purposes.

8. Privacy and Student Data

We take student privacy seriously. Our practices follow applicable laws, including FERPA and COPPA where required. For details, please review our Privacy Policy.

9. Third-Party Services and Integrations

Some features rely on third-party tools (e.g., video conferencing, assessment tools, or curriculum resources). These providers may have their own terms and privacy practices. By using our Services, you acknowledge that these tools are part of the learning experience.

10. External Websites

The service may link to third-party websites. We do not endorse or control these sites and are not responsible for the content, terms of service, availability, privacy controls, data protection or sharing policies, or other practices.

11. Service Availability and Changes

We work hard to keep our Services running smoothly, but we cannot guarantee uninterrupted access. We may modify or discontinue parts of the Services as needed.

12. Disclaimers

  • Our Services are provided "as is" without warranties of any kind.
  • We are not responsible for internet outages, device issues, or other factors outside our control.
  • Educational outcomes depend on many factors, including student engagement and parent/guardian support.

13. Limitation of Liability

To the fullest extent allowed by law, Miaplaza is not liable for indirect, incidental, or consequential damages arising from use of our Services.

15. Termination of Use

We may suspend or terminate access to our Services if a user violates these Terms or engages in behavior that disrupts learning or safety.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version with a new "Last Updated" date. Continued use of the Services means you accept the updated Terms.
